A GUIDELINE FOR VISA EXTENSION IN VIETNAM

Extending and renewing the Visa mean that the Vietnam Immigration Department will issue a new Visa stamp or visa sticker paper on your passport with new expiry date, so you are able to stay in Vietnam until that day. With visa extension and visa renewal, you do not need to leave the country, because the procedures will be done while you are in Vietnam. Foreigners who wish to extend or renew their visa for the temporary staying permission in Vietnam with the purpose for business, working, investment, study, visiting relatives, traveling, or others. They could extend their stay by using visa extension or renewal service, conducting this service depends on their current visa type, nationality, the time of the year and name of entry port, the visa extension allows them to stay more in Vietnam without leaving the country.

YOU NEED TO KNOW BEFORE EXTENDING OR RENEWING THE VISA IN VIETNAM

The visa extension and renewal include following cases:

· Business Visa: can be extended for from 1 month to 1 year maximum

· Tourist Visa: can be extended for 3 months maximum

· Visa exemption stamp: can be extended for 15 days

· Overstay the visa: can be extended for from 15 to 30 days

Note that the visa extension length depends on the current visa type, nationality, the time of the year and purpose. So we recommend you to contact directly to our team to check your case. Only a limited number of nationalities are eligible to apply for the visa extension or renewal, and the requirements change accordingly as well

CONDITIONS FOR VISA EXTENSION AND RENEWAL

1. Passport must be valid for more than 6 months from the time of extension and has at least 2 blank pages;

2. A valid Vietnam’s visa;

3. The required documents for business visa extension must have a sponsored company in Vietnam;

4. The duration of a visa shall be at least 30 days shorter than that of the passport or international laissez-passer;

5. Only a limited number of nationalities are eligible to apply for a visa extension/renewal, and the requirements change accordingly as well;

6. Providing the proof of temporary residence in Vietnam certified the local police station.

DIFFERENCE BETWEEN VISA EXTENSION AND RENEWAL

Visa extension:

Extending the visa means that you will be able to stay longer in Vietnam without leaving the country and this allow to extend your stay in Vietnam without reentering if you exit Vietnam before your visa expired. So it means you must apply new visa if you wish to come back Vietnam after leaving. Hence the extension fee is much cheaper than visa renewal

In order to apply visa extension, your current visa has to meet some requirements of Vietnam Immigration Department. Your current visa type has to be correspondent to your staying extending requirement.

Extending the visa for one month: The current visa must be one month or 3 month single or 3 month multiple entry visa
Extending the visa for three months: The current visa must be 3 month single or 3 month multiple entry visa
Extending the visa for 15 days: The current visa must be 15-day free visa exemption or 1 month single visa.

Visa Renewal:

Visa renewal is similar to extension, a small difference that you are granted a new visa stamp and visa sticker paper on your passport with the new duration permission. The staying length is valid from 1 month to 3 months depending on multiple factors like what documents and visa type do you have, your nationality, the time of the year, the visa law in Vietnam changing all the time and other stuff. Moreover the visa renewal fee is higher than the visa extension fee because we have to pay stamping fee and visa sticker fee for the government.

For the reasons mentioned above, you have the option of applying a new tourist or business approval letter for one month/three month, single/multiple entry visa which can be picked up the new visa at Moc Bai border grossing, where you cross to Cambodia and return instantly. This will certainly be more convenient, cheaper and save you a lot of hassle and time. While this procedure is not well-received by some officials, it is still perfectly legal.

Note that If you would like to upgrade your current visa from duration of 1 month to one of 3 months, or upgrade the current visa from single entry to multiple entry, you will have to go through the visa renewal process.

REQUIRED DOCUMENTS FOR VISA EXTENSION AND RENEWAL

Required documents for business/ working Visas

Foreigners who are working, doing business and having the sponsor company in Vietnam, containing a valid visa and passport marked the visa type of DN / LD / NN1/ NN2 / TT should prepare the following dossiers:

1. Company’s legal entity files (notarized certified copy of business registration certificate or investment registration certificate or establish Representative Office)

2. Seal registration certificate and tax code registration certificate (if any);

3. The original passport;

4. A valid Vietnam visa;

5. Vietnam work permit (if any);

6. Visa extension form signed and sealed by company’s legal representative

7. Original certificate of temporary residence in Vietnam (proof of residence);

8. In case of that foreigners accompany with their relatives, it’s required to provide the written proof of family relationships (the documents must be legalized, translated and notarized comply with the provisions of law):

a. The relatives recognized as spouse must have a marriage certificate;

b. The relatives recognized as children must have a birth certificate.

The processing time: 5-7 working days

Required documents for tourist, visitor visa

Foreigners who come to Vietnam for the purpose of tourist, relative visitor containing a valid visa and passport marked the visa type of DL, VR or visa exemption stamp should prepare the following dossiers:

1. The original passport;

2. A valid Vietnam visa marked as DL, VR or visa exemption stamp

3. Port of entry name;

4. Your current address in Vietnam;

5. Original certificate of temporary residence in Vietnam (if any);

You must apply extending Vietnam Visa some days before your visa date expires; it’d better before at least 1 week (for 3 months visa, preferably 2 weeks). Because it takes you 7 days to finish as submitting your passport and requirement at Vietnam Immigration Department Office, so applying soon may help you active in some ways.

If your passport is lost or stolen, you must follow the following steps:

1. Obtain a passport lost report certified by the local police station where you are temporarily staying;

2. Apply for a new travel document as passport/ travel permit/diplomatic note from the Embassy or Consulate-General;

3. Obtain an letter of confirmation from the Embassy or Consulate-General;

4. Obtain an exit or replacement visa in order to leave Vietnam.

DURATION AND VALUE OF VISA TYPES

1. The duration of a SQ visa is not longer than 30 days.

2. The duration of a HN or DL visa is not longer than 03 months.

3. The duration of a VR visa is not longer than 06 months.

4. The duration of a NG1, NG2, NG3, NG4, LV1, LV2, DN, NN1, NN2, NN3, DH, PV1, PV2 or TT visa is not longer than 12 months.

5. The duration of a LĐ visa is not longer than 02 years.

6. The duration of a ĐT visa is not longer than 05 years.

7. When a visa is expired, its reissuance shall be considered.

8. The duration of a visa shall be at least 30 days shorter than that of a passport or international laissez-passer.

WHAT HAPPENS IF YOU OVERSTAY YOUR VISA IN VIETNAM

To overstay your visa means to stay longer in the country than the visa legally allows you to. There are two types of penalty fees you must pay if that is the case – the “fine” fee, and the extension (if you want to and are able to) exit fee (if you are forced to leave the country). If you have only overstayed your visa for a period of less than 3 days, you are not required to go to the Immigration Office, and you can pay directly at the airport and get an exit visa to leave the country. The penalty fee for a longer overstay will be about 500,000 VND ($25USD) per day.

If you still want to remain in Vietnam, then pay the “fine” fee and get a visa extension stamp. A few legal documents will be required for this process, so contact the Immigration Department or visa agent in advance. If you overstay your visa due to a lost passport, the options are the same. But you must contact your embassy and apply for a new passport/travel permit/diplomatic note, then contact the police and write up the passport lost report, and finally arrange for a visa renewal through the Immigration Department.

Of course, the longer you overstay, the more complicated the procedure will be as the Immigration Department will need to track your legal activity record during this overstay period. Please remember that overstaying is a serious offense and to avoid all this, pay attention to your visa validity and that it coincides with your date of departure. Mistakes are made sometimes as we are all human.

STEPS TO OBTAIN AN INVESTOR VISA IN VIETNAM

Vietnam Investment Visa is coded as DT, which is quite different from Business Visa (DN) or Working Visa (LD) in terms of validity and specific applicants. This type of visa is issued for those who set up, contribute capital to Vietnam companies or practise as a foreign lawyer. Holding Investment Visa, you can stay in Vietnam up to one year to conduct your business or execute projects to develop the business structure and also expand markets. For the purpose of investment or working, you are required to obtain a Visa Business Approval Letter in advance sponsored by a company operated in Vietnam currently that is a requirement to pick up your visa. There are three channels to obtain an investment visa such as Vietnam Embassies or Consulate, E-visa or Visa on arrival. The required documents and the time process are different from Tourist Visa. To widen your business opportunities and invest in Vietnam, please satisfy these requirement and steps as below.

ALL YOU NEED TO KNOW ABOUT THE INVESTMENT VISA IN VIETNAM

Investment visa – Visa code as ĐT:

This type of visa is for foreign investors mentioned in the Enterprise Registration Certificate and the Investment Registration Certificate, or for lawyers having the Foreign Registered Lawyer Licenses. - The maximum validity of a multiple entry investment visa is 5 years on a case by case basis

Who is eligible for the Vietnamese Investment visa or Temporary Residence Card

The validity of investment visa is valid from 1 to 5 years on a case by case basis, the investment visa is granted for:

§ Member of a limited company with at least 2 members;

§ Owner of one member Limited Company in Vietnam (except for Representative of being authorized);

§ Member of Board of Directors of a Vietnamese Joint-stock Company;

§ Foreign Lawyers are granted with law work permit in Vietnam;

§ Foreign employers with related work permit working in Vietnamese enterprises or Representative offices of foreign company in Vietnam – Professionals, students, trainees working or studying in national programs and projects signed by ministries and approved by the Government.

§ Relatives of the temporary resident card holder include: parents, spouse and children

THREE WAYS OF OBTAINING A VISA FOR VIETNAM
Most people need a visa in order to enter Vietnam, unless they are coming from one of the visa-exempt countries. There are three ways of obtaining such a visa:

· Apply in person or by post through your nearest Vietnamese Embassy or Consulate;

· Apply for a Visa on Arrival (VOA) or;

· Apply for an e-visa online

While there are advantages and disadvantages associated with each of these, we recommend the Visa on Arrival as the best option for the purposes of tourist, business and work considering a trip to Vietnam.

Option 1: Vietnam Visa on Arrival

Key Features:

· Convenient, as it can be done by completing an online application form

· Can be used to apply for any type of visa (1- 3, or 6 months, or 1 year multiple-entry visa)

· You will need to pay two fees: 1. Service fee for approval letter, 2. Stamping fee.

· The service fee is paid online to the service provider. The amount depends on the visa type (number of months and number of entries) and service provider.

· The stamping fee is paid at the arrival airport when the visa is stamped. The fee starts at USD25 for 1 month and 3 month single entry, USD50 for 1 and 3 month multiple-entry visas. The stamping fee must be paid in cash (USD or VND).

· Can only be obtained at Vietnam’s international airports in Hanoi, Danang, Ho Chi Minh, Cam Ranh or Phu Quoc Airport. Hence it is only an option for air passengers.

· For tourist approval letter takes about 2 working days to process and can be sped up to 1 day or 4 hours for an extra charge. While the business approval letter takes 5 working days to process

Visa on Arrival is a viable option with various advantages. With Visa on Arrival, you can apply for longer-term and multiple-entry visas, and you do not need to go in person to the Embassy, or apply by post. You just need to submit an online application and get a pre-approval letter.

Option 2: Via Vietnamese Embassy or Consulate

Key Features:

· Traditional approach to getting a visa

· Can be done in person or by post

· Can be used to apply for any type of visa

· The fee is uncertain as it depends on the consulate/ embassy

· Can be used for any entrance point, whether by land, air, or sea

· Takes about 5 working days to process, but can be sped up to 1- 2 days for urgent service.

· Visa is stamped before departure.

You can apply for a visa through the local Vietnamese Embassy or Consulate either in person or by mail. To do this, you need to fill out and sign an application form, sending it along with your passport and a passport photo.

The advantage of applying this way is that you already have the visa stamped in your passport before leaving for Vietnam, which means you do not need to queue on arrival for your passport to get stamped.

The application process is not the most convenient, however, especially for people who do not live near a Vietnamese Embassy or Consulate. Moreover, the fees vary depending on the Embassy or Consulate, and the processing time is longer.

Option 3: E-Visa

Key Features:

· Very recent, was only launched on 1 February 2017

· Convenient, as it can be done by completing an online application form

· Only costs USD 25, which is non-refundable if the visa is declined.

· May be used for any entrance point, whether by land, air, or sea. (There are 28 entrance points, including 8 international airports, 13 international border gates, and 7 seaports.)

· Only for 1 month single-entry.

· Takes about 3 working days to process, and you’ll know quickly whether the application was accepted or not.

· The visa does not need to be stamped on your passport; hence there is no stamping fee and no need to queue for your passport to be stamped on arrival.

· Only available to citizens of 46 countries (including the UK and the USA).

Applying for an e-visa is our recommended option for tourists as it is most convenient and cost-effective. However, please note that this visa is only for visitors visiting for less than 30 days. Longer-term visitors will need to consider the other two options.

Please Note that the arrival port must be the same on the documents issued by Immigration Department. If you are to change the arrival port after receiving your E-visa, you should contact them to amend the information on the documents to avoid any issue on the ground.

HOW TO APPLY FOR A VIETNAM INVESTMENT VISA

If you're planning to get a business, working, investment visa in Vietnam, you need to have a sponsored company has been registered and operating in Vietnam. The whole procedure for the investment visa must go through 2 steps: 1- The first step, have a visa Approval Letter (Pre-Visa) sponsored by a company in Vietnam, issued by the Ministry of Public Security in advance; 2- The second step, the applicant pick up the investment visa by themselves at the Vietnam’s international airports; Vietnamese Embassies/ Consulates overseas; or Vietnam’ international border crossings.

Obtaining a Investment approval letter from Vietnam Immigration Department

For the purposes of investment, business, or work, the applicants are required a Visa Approval Letter from the Ministry of Public Security in advance obtained by a company in Vietnam. The Visa Approval Letter is the legal document approved by the Vietnam Immigration Department to allow foreigners enter into Vietnam and pick up visa at Vietnamese Embassies/ Consulates in your own or another country; or Vietnam’ international border crossings; or at all Vietnam’s international airports upon arrival: the international airports include Noi Bai International Airport (Hanoi); Tan Son Nhat International Airport (Ho Chi Minh City); Da Nang International Airport (Da Nang); Cam Ranh International Airport (Nha Trang); Phu Quoc International Airport (Kien Giang)

The required documents need to provide both the applicant and Vietnam’s sponsor company

1. A notary certified copy of sponsor company’s business or investment or representative license in Vietnam, tax and stamp registration certificate;

2. Visa application forms must be signed and sealed by a legal representative of the company;

3. Scanning the applicant’s passport;

4. Providing the proposed date of arrival (this is the date you want your visa to start from. The start date of the visa itself will be the day you arrive - you can enter Vietnam at a later date (up to your exit date) but not before that date, so be sure to take time zone differences into account);

5. The place of picking up the visa at any Vietnam international airports: Ho Chi Minh City, Hanoi, Da Nang, Cam Ranh, or Phu Quoc

The visa duration is from 1 to 12 months with single or multiple entries

Normal processing time: 7 working days

Required documents for picking up the Vietnam Investment Visa

You are able to get your visa stamped at the embassy or the airport or border crossing, to do this you must submit the following documents:

1. Applicant’s original passport must be valid for six months from your intended arrival date, and must have at least one blank visa page;

2. 2 passport sized photographs (4x6 cm);

3. The copy of visa approval letter;

4. Complete the entry and exit application form;

5. Visa stamping fee depending on the visa single or multiple entry and visa validity (USD25 for 1 and 3 month single, USD50 for 1 and 3 month multiple, USD95 for 6 month multiple and USD135 for 1 year multiple entry) must be paid in cash at the place of visa picking up

WHERE TO PICK UP THE VIETNAM INVESTMENT VISA

There are three options to obtain Business Visa for those that require it

1. Obtain the visa at Vietnamese Embassies/ Consulates in your own or another country or

2. Obtain the visa at Vietnam’ international airports including Tan Son Nhat airport in Ho Chi Minh City, Noi Bai airport in Ha Noi City, Cam Ranh airport in Nha Trang, Da Nang airport in Da Nang City or Phu Quoc airport in Kien Giang Province or

3. Obtain the visa at Vietnam’ international border crossings, Vietnam has over a dozen international overland border crossings. These allow overland travel to Cambodia (via five crossings), Laos (via six crossing) and China (at least two crossings)
